The Power of Attorney

Where will you sign it?
What is it for?
Scope

A Special (specific) Power of Attorney limited to named acts is safer and harder to misuse. A General PoA grants broad authority — choose it only if you truly need it.

Common questions

Do I have to travel to India to make a Power of Attorney for my Kerala property?

No. For most NRIs the Power of Attorney is signed before a local notary and then either apostilled (USA, UK, Canada, EU, Australia — all Hague Convention countries) or attested by the local Ministry of Foreign Affairs and the Indian Embassy (Gulf countries). It is then sent to Kerala, where it is adjudicated and, for property sales, registered at the Sub-Registrar. The signing happens where you live — no India trip is needed to create the PoA.

What does the flat fee cover?

It is a single, all-inclusive fee covering the advocate drafting your Power of Attorney for your exact matter, guiding the apostille or Indian Embassy attestation route for your country, and coordinating stamp-duty adjudication and Sub-Registrar registration in Kerala. The fee is shown up front, and payers abroad see the equivalent amount in their local currency.

Should I give a General Power of Attorney or a Special Power of Attorney?

For a specific task — selling one property, completing a mutation, or representing you in one matter — a Special (specific) Power of Attorney is safer. A General Power of Attorney grants broad authority and is far more open to misuse. The PoA should name the exact property by survey number, village, taluk, and district, and list only the powers actually needed.

How do I stop my relative or agent from misusing the Power of Attorney?

The most common safeguards are: keep it Special (not General), limit it to named acts, set an expiry, require that sale proceeds go only to your own NRO/NRE account, and register the PoA so it is on record. A revocation can be executed and notified if trust breaks down. The drafting stage is where most misuse is prevented — vague, over-broad PoAs are what get abused.

What is the difference between apostille and embassy attestation?

Apostille is a single certificate added by the competent authority in Hague Convention countries (USA, UK, Canada, EU, Australia) and is accepted directly in India. Gulf countries are not in the Hague Convention, so the PoA instead goes through the local Ministry of Foreign Affairs and the Indian Embassy or Consulate for attestation. The route depends entirely on where you live.

I just want to understand the process — do I have to pay for the full service?

No. If you only want to understand which powers, clauses, and attestation route your Power of Attorney needs, the free PoA Builder walks you through it by country. The paid service is for when you want an advocate to actually draft, attest, and register the document for you. For a specific question, you can book a consultation instead.

How it works

How to execute a Power of Attorney for Kerala property

Whether you are in Kerala or handling a property matter back home from abroad, an advocate can draft, attest, and register your Power of Attorney without a trip to India. Here is the whole process.

  1. Answer a short questionnaire

Tell us the country you sign in, the purpose, the scope, the property, and who will represent you — in your own words. A few minutes, no legal drafting required from you.

  2. Pay a flat, all-inclusive fee

One fixed price covering drafting, attestation guidance, and Kerala registration coordination — government charges included. Paying from abroad? The same fee is shown in your local currency.

  3. Share your documents

Upload a government photo ID and your property documents so the advocate can draft the Power of Attorney accurately for your exact matter.

  4. An advocate drafts, attests & registers it

Advocate Anakha drafts the Power of Attorney, confirms the wording, guides the apostille or Indian Embassy attestation route for your country, and coordinates adjudication and Sub-Registrar registration in Kerala.

By your country

Apostille or embassy attestation — the route depends on where you live

USA, UK, Canada, EU, Australia

Hague Convention countries. The PoA is notarised locally, then apostilled by the competent authority — a single certificate accepted directly in India.

UAE & the Gulf

Not in the Hague Convention. The PoA is attested by the local Ministry of Foreign Affairs and then the Indian Embassy or Consulate before it is used in Kerala.

Singapore, Germany & others

Route depends on the country. We confirm whether apostille or embassy attestation applies and draft the document so it is accepted first time.

Kerala-side registration

For a sale or transfer, the PoA is adjudicated for stamp duty at the District Collectorate and registered at the Sub-Registrar — coordinated for you.

For NRIs & OCI card holders

Getting a Power of Attorney done from abroad

You do not need to fly back to India to create a Power of Attorney for your Kerala property. NRIs and OCI card holders in the UK, USA, UAE, Canada, Australia, Singapore and beyond can start the whole process online — you provide the details and documents, and an advocate drafts the PoA, guides the attestation route for your country, and coordinates adjudication and registration in Kerala on your behalf. Payment works in your local currency, and the document is drafted specifically for your matter so it is hard to misuse and unlikely to be rejected.

Cost

A flat, all-inclusive fee

The fee is fixed and shown before you pay — there is no hourly billing. It covers an advocate drafting your Power of Attorney, confirming the wording with you, guiding the apostille or Indian Embassy attestation route for your country, and coordinating adjudication and Sub-Registrar registration in Kerala. Payers abroad see the same fee converted to their local currency.

Only need to understand the process? The free PoA Builder walks you through the powers, clauses, and attestation route by country before you commit.
