The Power of Attorney

Where will you sign it?
What is it for?
Scope

A Special (specific) Power of Attorney limited to named acts is safer and harder to misuse. A General PoA grants broad authority — choose it only if you truly need it.

Common questions

Do I have to travel to India to make a Power of Attorney for my Kerala property?

Many NRIs can sign in their country of residence and coordinate the Kerala-side steps without an immediate India trip. The correct route depends on the exact country, citizenship, document eligibility and intended Kerala authority. Any later personal appearance or travel requirement must be confirmed for the transaction before signing.

What does the flat fee cover?

The displayed fee covers advocate drafting, confirmation of the wording with you, country-route guidance, Kerala-side coordination, and the standard Kerala government charges for the agreed Power of Attorney route. Unless expressly confirmed in writing, foreign notary, apostille authority, Indian mission or application-centre fees, local authentication, translation, courier, banking, tax or CA charges, and non-standard statutory charges are paid separately.

Should I give a General Power of Attorney or a Special Power of Attorney?

For a specific task — selling one property, completing a mutation, or representing you in one matter — a Special (specific) Power of Attorney is safer. A General Power of Attorney grants broad authority and is far more open to misuse. The PoA should name the exact property by survey number, village, taluk, and district, and list only the powers actually needed.

How do I stop my relative or agent from misusing the Power of Attorney?

Common safeguards include using a specific rather than broad authority, limiting it to named acts and property, setting an appropriate end point, and requiring sale proceeds to go only to an account in the principal's own name through the correct bank and FEMA route. Complete any registration required for the final powers and relationship. If trust breaks down, the instrument, existing acts, third-party rights, notice, and any authority coupled with an interest must be reviewed before a revocation is executed and notified.

What is the difference between apostille and embassy attestation?

An apostille authenticates the signature, capacity and seal on a qualifying public document from a Convention country; it does not approve the PoA wording or complete Kerala stamp or registration requirements. Saudi Arabia and Oman are Convention parties, while the UAE, Qatar and Kuwait are not currently parties. Indian mission execution or attestation may also be available, so the exact route must be confirmed before signing.

I just want to understand the process — do I have to pay for the full service?

No. If you only want to understand which powers, clauses, and authentication route your Power of Attorney may need, the PoA Builder starts free and offers a 30-day paid unlock for the full guide. The execution service is for advocate drafting, route guidance, and coordination of the applicable Kerala steps. For a specific question, you can book a consultation instead.

How it works

How to execute a Power of Attorney for Kerala property

Whether you are in Kerala or handling a property matter back home from abroad, an advocate can draft your Power of Attorney, guide the country authentication route, and coordinate the applicable Kerala steps. Here is the service sequence.

  1. Answer a short questionnaire

Tell us the country you sign in, the purpose, the scope, the property, and who will represent you — in your own words. A few minutes, no legal drafting required from you.

  2. Pay a fixed service fee

Advocate drafting, country-route guidance, Kerala coordination, and standard Kerala government charges for the agreed route.

  3. Share your documents

Upload a government photo ID and your property documents so the advocate can draft the Power of Attorney accurately for your exact matter.

  4. An advocate drafts and coordinates it

Advocate Anakha drafts the Power of Attorney, confirms the wording, guides the country authentication route, and coordinates the Kerala stamp or Sub-Registrar steps that apply.

By your country

Apostille or embassy attestation — the route depends on where you live

USA, UK, Canada, Australia, Singapore, Germany

An apostille route may apply to a qualifying notarised document. We confirm the mission guidance and intended Kerala authority before the document is signed.

Saudi Arabia & Oman

Both are Apostille Convention parties, and Indian mission services may also be available. The correct route depends on the instrument and citizenship.

UAE, Qatar & Kuwait

These are not currently Apostille Convention parties. We confirm the current local-authentication or Indian mission route before signing.

Kerala-side registration

The final powers and the statutory relative exception determine the Kerala stamp and registration route. Overseas authentication does not itself complete registration.

For NRIs & OCI card holders

Getting a Power of Attorney done from abroad

Many NRIs can begin a Kerala Power of Attorney from their country of residence. NRIs and OCI card holders in the UK, USA, UAE, Canada, Australia, Singapore and beyond can start the service online — you provide the details and documents, and an advocate drafts the PoA, guides the authentication route for your country, and coordinates the applicable Kerala stamp or registration steps. Payment works in a supported local currency, and the document is drafted specifically for your matter, with safeguards and any remaining appearance or acceptance risk explained before the next step.

Cost

A fixed service fee with a defined scope

The fee is fixed and shown before you pay — there is no hourly billing. It covers an advocate drafting your Power of Attorney, confirming the wording with you, guiding the confirmed authentication route for your country, and coordinating the applicable Kerala stamp or Sub-Registrar steps. Payers abroad can use a supported local-currency payment option.

Unless expressly confirmed in writing, foreign notary, apostille authority, Indian mission or application-centre fees, local authentication, translation, courier, banking, tax or CA charges, and non-standard statutory charges are paid separately.

Only need to understand the process? The PoA Builder starts free and walks you through the powers, clauses, and attestation route by country before you commit.
